TERMS & CONDITIONS APPLY MEMBERSHIPS TERMS & AGREEMENT Please Read the Full Terms & Conditions of Zia Wellness Spa, llc (aka 'Spa') Memberships 1. Membership Enrollment & Commitment Initial Commitment Period: Your Membership requires a 3-month minimum commitment from the date of enrollment. This means that you must remain a member for at least three (3) months. If you choose to cancel your Membership before completing this 3-month commitment, you will be charged a $25 early termination fee. Membership Benefits: As a Member, you are entitled to the benefits outlined in your chosen Membership package (e.g., a set number of spa services per month, discounted rates, or other perks as specified). 2. Membership Fees & Payment Monthly Membership Fee: A monthly Membership fee will be charged to your payment method on file on a recurring monthly basis. Payment Authorization: By enrolling in the Membership, you authorize the Spa to charge the monthly Membership fee to the payment method you provided. Fees will be charged on the first of every month. 3. Cancellation Policy & Termination Cancellation After 3-Month Commitment: After the initial 3-month commitment period, you may cancel your Membership by providing at least 30 day notice to the Spa. Notice must be sent via email or in writing, and will be considered effective on the date received by the Spa. If you verbally cancel with one of our Front Desk Receptionist or Managers, you will receive an email as the confirmation we received your 30 day notice. Early Termination (Before 3-Month Commitment): If you choose to cancel your Membership before completing the initial 3-month commitment, you will incur a $25 early termination fee. The Membership fee will not be refunded for any remaining months in your commitment period. Automatic Renewal: After the initial 3-month commitment period, your Membership will automatically renew on a month-to-month basis unless you cancel it in accordance with the terms outlined above. 4. Monthly Rollover & Expiration Rollover Policy: Any unused services or credits from your monthly Membership will roll over into the next month. The rollover credits do not expire and will continue to accumulate as long as you maintain an active Membership. Limitations on Rollover Usage: Rollover credits can only be used for services covered under your Membership plan and cannot be used for products, upgrades, or services outside of the agreed package. 5. Member Exclusivity Non-Transferable Membership: Your Membership is non-transferable and can only be used by you, the Member. Membership benefits, services, and rollover credits are for the personal use of the Member only and cannot be shared with family members, friends, or any third parties. 6. Membership Benefits & Services Spa Services: Your Membership includes access to the spa services outlined in the Membership package you selected (e.g., facials, massages, body treatments, etc.). Specific details regarding the number and type of services included in your Membership can be found in your membership agreement or on the Spa’s website. Discounts: You may be eligible for discounts on other services and products offered by the Spa, as specified in your Membership plan. These discounts apply only to services and products purchased at the time of your visit. 7. Membership Changes & Modifications Changes to Membership Plan: The Spa reserves the right to modify or update the benefits, services, or fees associated with the Membership at any time. You will be notified in advance of any such changes. If you do not wish to continue with the Membership under the new terms, you may cancel your Membership following the cancellation process outlined above. 8. Spa Rights and Disclaimers Spa Discretion: The Spa reserves the right to refuse service to any Member for reasons including, but not limited to, inappropriate behavior, abuse of the Membership privileges, or failure to comply with Spa policies. No Refunds: Membership fees are non-refundable, including in cases of early cancellation, missed appointments, or unused services. Health & Safety: Members must notify the Spa of any health conditions, allergies, or other concerns before using the services. The Spa will make reasonable accommodations but is not responsible for any adverse reactions to treatments. 9. Liability Waiver Assumption of Risk: By enrolling in the Membership and using the Spa services, you acknowledge and accept any inherent risks associated with spa treatments and agree to hold the Spa harmless for any injury, harm, or adverse effects that may occur during or after the treatments. 10. Governing Law This Membership Agreement shall be governed by and construed in accordance with the laws of the state of Texas, and any legal action or dispute shall be resolved in the appropriate jurisdiction within that state.
